According to liberal political philosophy, human beings, who inherently possess equal rights and freedoms, initially formed society whereas the state came later through the so- cial contract in order to maintain the natural state of peace. In other words, society emerged initially through horizontal relations while the formation of state followed through ver- tical relations. The state is expected to provide security and justice while being constrained by the natural rights posses- sed in the state of nature. Thus, within the context of vertical relationship between the individual and the state, the modern state is positioned as both the greatest threat to and protector of human rights. This situation, at the outset, triggered the emergence of certain group of rights that the state should not interfere with. However, the industrial revolution and eco- nomic depressions demonstrated that this criterion remained insufficient. It has been understood that human beings cannot lead a life with dignity as long as the assumption of a theoreti- cal equality before the law prevails as the sole element, that is, as long as a minimum level of equality between people is not achieved. Consequently, the socio-economic rights group has surfaced. Furthermore, especially following the contributions of the international protection system, positive obligations of the state have been established in addition to the state’s nega- tive obligations as to human rights. Despite the developments in the vertical relationship between the individual and the sta- te, the protection of human rights has not reached a sufficient level. With the acceleration of globalization, non-state actors as powerful as the state have emerged, and violations of fun- damental rights in horizontal relations have frequently beco- me widely discussed issues. Accordingly, the concept of the horizontal impact of human rights has developed, particular- ly in German doctrine and jurisprudence. In this regard, the concept has been mostly addressed in its technical dimension in the doctrine. Nevertheless, the issue is rather related to the position of the state in the context of human rights according to the perspective of state theory. In this context, this paper will touch upon the concept of horizontal effect and its app- lications and subsequently the position of the state vis-à-vis human rights will be evaluated in this context.
