Özet

Bu çalışmada, 5237 sayılı Türk Ceza Kanunu’nun 106. maddesinde düzenlenen tehdit suçu bütüncül bir yaklaşımla ele alınmaktadır. Öncelikle tehdit suçunun mevzuattaki düzenleniş biçimi ve ceza hukuku sistematiği içerisindeki yeri ortaya konulmakta; ardından suçla korunan hukuki değer açıklanmaktadır. Tehdit suçunun uygulamada sıklıkla karıştırılabildiği benzer suç tipleriyle karşılaştırmasına yer verilmekte ve mukayeseli hukukta tehdit suçunun ele alınış biçimi incelenmektedir. Devamında yüksek yargı kararları ve doktrindeki görüşlerden yararlanılarak suçun maddi unsurları ayrıntılı biçimde analiz edilmekte; bu kapsamda fiil, fail, mağdur, suçun konusu ve nitelikli hâller değerlendirilmektedir. Çalışmada ayrıca suçun manevi unsuru, kast türleri ve saik bakımından ele alınmakta; hukuka aykırılık unsuru ile kusurluluk ve kusurluluğu etkileyen nedenler irdelenmektedir. Bunun yanında teşebbüs, iştirak ve içtima gibi suçun özel görünüş şekilleri açıklanmakta; son olarak tehdit suçunun uzlaştırma, şikâyet, hükmün açıklanmasının geri bırakılması ve cezanın ertelenmesi kurumlarına tabi olup olmadığı, dava zamanaşımı süresi, etkin pişmanlık ve izin gibi muhakeme hukukuna ilişkin hususlar ele alınmaktadır.
This study examines the crime of threat regulated under Article 106 of the Turkish Penal Code No. 5237 through a comprehensive approach. First, the manner in which the crime of threat is regulated in the legislation and its position within the systematics of criminal law are addressed; subsequently, the legal value protected by the offense is explained. Comparisons are made with similar crimes that are highly likely to be confused with the crime of threat in practice, and the treatment of the offense in comparative law is analyzed. Thereafter, by making use of high court decisions and doctrinal opinions, the material elements of the offense are examined in detail; within this scope, the act, perpetrator, victim, subject matter of the crime, and its qualified forms are evaluated. The study also addresses the moral element of the offense in terms of intent and motive; additionally, the element of unlawfulness, as well as culpability and factors affecting culpability, are analyzed. Furthermore, the special forms of appearance of the crime, such as attempt, participation, and concurrence, are explained. Finally, procedural law issues related to the crime of threat—such as whether it is subject to reconciliation, complaint, deferment of the announcement of the verdict, or suspension of the sentence, as well as the statute of limitations for prosecution, effective remorse, and permission requirements—are discussed.
