İnsanlar doğası gereği huzurlu ve güvenli bir ortamda birlikte yaşamak isterler. İnsanların toplu bir şekilde yaşamlarını sürdürebilmeleri için bazı kurallara ihtiyaç vardır. İşte bu kuralları koyacak otoriteye devlet denmektedir. Devletin en temel görevi toplumda güven ve huzuru temin etmektir. Devlet bu anılan görevleri kolluk görevlileri vasıtasıyla yerine getirir. Kolluk görevlilerinden biri olan polislik zor ve hassasiyet isteyen bir görevdir. Polis yaptığı görevin gereği olarak bazen bir engelle veya direnişle karşılaşabilir. Böyle durumlarda polis mukavemeti aşmak için zor ve silah kullanma yetkisine sahiptir. Bu yetkiler polise yasalarla tanınmıştır. Ayrıca unutulmamalıdır ki, polis bu yetkileri kullanırken ölçülülük ilkesine mutlaka uymak zorundadır. Polis toplumsal olaylara müdahale ederken aşırı ve orantısız güç kullanamaz. Kolluk tedbirleri en hafiften başlayarak ağıra doğru giden bir sıra ile uygulamalı ve kademeli bir şekilde artırılmalıdır. Aksi halde kolluk yetki sınırını aşar ve suç işlemiş olur. Bu çalışmada polisin idari kolluk yetkileri ölçülülük ilkesi ve unsurları dikkate alınarak incelenmiştir.
People want to live together in a peaceful and safe environment by their nature. Some rules are needed for people to live together. The authority that will establish these rules is government. The basic duty of the government is to ensure peace and safety of society. Government performs these duties through law enforcement. Being police, which is one of the law enforcement tasks, is difficult and it also requires sensitivity. Because of their job, the police may sometimes come across an obstacle or resistance. In such cases, the police have the authority to use brute force or firepower in order to defeat the resistance. The police have these authorities through the law. It should also be noted that the police must strictly follow the principle of proportionality when using these powers. The police can not use extreme and dispropotionate force during intervention in public events. Law enforcement measures should be taken from the lightest to the most intense and these measures should be increased gradually. Otherwise law enforcement exceeds authorization limits and commits crime. In this study, the administrative law enforcement powers of the police are surveyed by paying attention to the principle of proportionality and its aspects.
