Turkish Code of Obligations defines the Prokurist as a person who has been expressly or tacitly granted by the owner, with the authority to conduct operations at commercial enterprise and to sign per procuration under the title of owner's commercial name. However, the regulation does not include detailed provisions in the matter of the legal possibility of legal entities to be granted as Prokurist. As a consequence, different approaches have been expressed by the doctrine on the issue. This article; examines if legal entities can be appointed as Prokurist, in the framework of modern approaches to commercial enterprises and the general principals of Turkish Commercial Code No:6102 besides the doctrinal views and special provisions of related regulations.
